We hope you will enjoy being a member and that you’ll get good value from your membership in this house and pet sitting online platform. Members of HouseSitMexico must acknowledge, accept, respect and abide by these terms and conditions.

HouseSitMexico Terms and Conditions of Use

Section A: Overview

Truthfulness and Authenticity of Members
All members must be honest in word and action whether before, during or after any house-sitting assignment. This includes all communication whether through in-system messaging, or any other form of contact.

Homeowners/renters must not misrepresent any information (written or photographic) in their listings or in messaging regarding their identities or anything about themselves, pets, the home, location, responsibilities or any aspect of the house-sitting assignment.

House sitters must fill out their online PROFILE, including a photograph of themselves, and submit it as complete prior to applying to house sitting assignments. Sitters must not misrepresent any information (written or photographic) shared in their Profile or through any other means. This includes their identity, references, their age, location, citizenship, visa status, knowledge, experience, physical capabilities, or any other type of capability.

Reliable Fulfillment of Agreement
Members must responsibly fulfill and respect all the terms, requirements, and definitions of the housesitting assignment as entered into by both homeowner/renter and the house sitter/s. We strongly advise both homeowners/renters and sitters that their house-sitting agreement have its terms memorialized in writing, however verbal agreements must be respected as well as those that are written. In the case of repeat house sitting arrangements, the agreement between parties should be memorialized in writing each time.

Safety and Security
HouseSitMexico homeowner/renter members share their homes, furnishings, and often pets with the house sitter they select. We ask all members to respect others’ property, information, and personal belongings. All members must refrain from endangering, threatening or harming any person, pet or thing. Homeowners/renters should not have a) unsecured weapons, b) disease risks, or c) dangerous animals in their premises or in any way associated with the responsibilities of the sitter. House sitters may not bring any of the aforementioned (a, b, and/or c) to the house-sitting assignment. If a homeowner has video or audio surveillance equipment operational anywhere on their property, it must be divulged to the house sitter.

Separate Agreement Between Members
Relating to any sit you may arrange via HouseSitMexico or via contact with any of our members, you are entering into an agreement between yourself and a homeowner (or renter) or with a house sitter (as applicable to your situation). The agreement made between members is the responsibility of the members involved, and is not the responsibility of HouseSitMexico. To be clear: HouseSitMexico is not party to any agreement (verbal, contractual or otherwise), between members.

Bad Behavior On the Part of Any Member
Members are required to fulfill obligations to which they have mutually agreed (whether verbally, in writing, or contractually), including the dates, requirements and terms of a house sit.

Rudeness, deceit or other forms of bad behavior by members of HouseSitMexico (whether to HouseSitMexico management, a fellow member, a neighbor, household employee, or any other person in any way connected to a house-sitting assignment or utilization of HouseSitMexico.com) is not tolerated.

Determination as to whether a HouseSitMexico member has failed to comply with any portion of our Terms and Conditions, or has failed to fulfill agreements relating to a house-sitting assignment, is entirely at the discretion of HouseSitMexico management, and may result in the uncompensated loss of membership, as well as being blocked from future re-joining.

 

1. Introduction

1.1 These terms and conditions shall govern your use of our website.

1.2 By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.

1.3 If you register with our website, submit any material to our website or use any of our website services, we will ask you to expressly agree to these terms and conditions.

1.4 You must be at least 21 years of age to use our website; and by using our website and by agreeing to these terms and conditions, you warrant and represent to us that you are at least 21 years of age.

1.6 The term, “homeowner” (or “homeowner/renter” as used interchangeably on the website) refers to the member whose home is to be the site of the house-sitting assignment.

1.7 Homeowner/members using the HouseSitMexico.com website must either be the owner of the site where house-sitting is to take place, or they must have permission of the owner, co-owner, manager or the property’s assignee.

2.2 Subject to the express provisions of these terms and conditions: (a) we, together with our licensors, own and control all the copyright and other intellectual property rights in our website and the material on our website; and (b) all the copyright and other intellectual property rights in our website and the material on our website are reserved.

3. License to use website

3.1 You may: (a) view pages from our website in a web browser; (b) download pages from our website for caching in a web browser; (c) print pages from our website; 3 (d) stream audio and video files from our website; and (e) use our website services by means of a web browser, subject to the other provisions of these terms and conditions.

3.2 You may only use our website for your own personal purposes, and you must not use our website for other people (beyond you, your spouse and family, and/or partner) or for any other purpose.

4. Acceptable use

5. Registration and accounts

5.1 To be eligible for an individual account on our website under this Section 5, you must be at least 21 years of age.

5.2 You may register for an account with our website by completing and submitting the account registration form on our website.

5.3 You must not allow any other person (other than a partner or member of your household) to use your account to access the website, nor may you share privileged information you acquire as a member of HouseSitMexico. You may not share contact information relating to a current, potential or future hypothetical house-sitting assignment which you learn of through your HouseSitMexico membership.

5.4 You must notify us in writing immediately if you become aware of any unauthorized use of your account.

6. User login details

6.1 If you register for an account with our website, you will be asked to choose a password, which you must keep confidential.

6.2 You must not use your account in connection with the impersonation of any person.

6.3 You must notify us in writing immediately if you become aware of any disclosure of your password.

6.4 You are responsible for any activity on our website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

7. Cancellation and suspension of account

7.1 You may cancel your membership (account) by sending an email to [email protected], informing us of your decision. You will not be entitled to any refund if you choose to cancel your account.

8. House Sitter and Homeowner Services

8.1 To become a member of HouseSitMexico, you must pay the applicable membership fee for the type of membership selected during the account registration procedure. We will send you an acknowledgement of your order. The contract between us for the supply of the website services shall come into force upon the issue of the order acknowledgement.

8.2 Registered users with active membership will be able to access house sitting related services on our website, which depending on whether the member is a homeowner and/or a house sitter may include: (a) the publication of a house sitter’s Profile on our website (for house sitters); (b) the publication of house sitting Assignments (for homeowners and/or renters) also known as “listings”; (c) the ability by homeowner/renters to view house sitters’ Profiles and contact sitters for the purpose of finding a house sitter without publishing a listing to the website, (d) access to our searchable database of available house sits; (e) in-system messaging after publication of a house sitting assignment to and from other HouseSitMexico members; and (e) posting to the website’s Members’ Blog (pending editorial approval by HouseSitMexico’s administration).

8.3 Members who are house sitters may not charge for their services as house sitters for assignments through HouseSitMexico, nor may members who are Homeowners/Renters charge HouseSitMexico sitters for their accommodations during the period of the house sit. Any terms relating to excess utilities cost or services provided by others (such as gardeners or housekeepers) during the house-sitting assignment are understood to be a separate agreement between the parties, and should be included in their written agreement.

8.4 HouseSitMexico has no way to know what house-sitting assignments will be posted, or how many will be available at any given time. The availability of house-sitting assignments is up to our homeowner/renter members.

8.5 It is up to the homeowner/renter as to whom they choose as a house sitter. There is no guarantee to house sitters that they will either encounter a desirable house-sitting assignment they may wish to apply for, nor is there a guarantee of being accepted as a house sitter.

8.6 At the end of any period of membership for which you have paid, and subject to the other provisions of these terms and conditions, your membership will be automatically cancelled, unless you renew the membership and pay the applicable fees. HouseSitMexico does not “auto-renew” membership.

8.7 Save where expressly requested or permitted by us to do so, you must not add any information to our website that may facilitate direct communications with other users (including without limitation email addresses, postal addresses, instant messaging IDs, telephone numbers, fax numbers, personal website URLs, and social networking profile URLs. Such information enabling direct contact is specifically prohibited from appearing in house sitting assignments (listings) as the information describing listings is shown publicly and is not private.

8.8 You acknowledge that we cannot be held responsible for the behavior of our users, either on or off the website, and we cannot guarantee that any information provided by a user is true, accurate, complete, current and not misleading; and will not hold us liable in respect of any loss or damage arising out of any user behavior or user information.

8.8 Any HouseSitMexico member (either homeowner and/or house sitter) known to have broken a firm house-sitting agreement without good cause will lose the remaining portion of their membership in HouseSitMexico without a refund.

8.9 Failure to comply with these Terms and Conditions is adequate reason for those members to lose the remaining portion of their membership in HouseSitMexico without a refund.

8.10 We may from time to time vary the benefits of membership.

9. Online Content of House Sitter Profiles and House-Sitting Assignments

9.1 All information that you supply on or to the website (including video, photos, text or other media), including all that which may be part of a house sitter Profile or Listing of a house-sitting Assignment, must be true, accurate, current, complete and non-misleading.

9.2 House sitters must create a House Sitter Profile (with photograph) on our website, and keep it up to date.

9.3 House sitter Profile information must also comply with the provisions of Section 4 and Section 13.

9.4 House sitters will not charge for their services.

9.5 Homeowners/renters will provide sitters with a place to stay at no charge as a condition of their house-sitting assignment. Homeowners/renters may however limit freely provided use of air conditioning or other utilities. Terms of the assignment must be mutually understood and agreed to at the time of confirming the assignment.

10. Money back guarantee

10.1 After publishing their first house sitting assignment, homeowners/renters can qualify for a full refund if they do not find a sitter they wish to select. To qualify for a refund, they must have utilized the website’s features to seek a house sitter in good faith. Doing so includes listing the house-sitting assignment online and communicating with applicants.

10.2 Members who wish to house sit and are unsuccessful in being selected as house sitters do not qualify for a money back guarantee.

10.3 We will refund money using the same method used to make the payment.

11. Your content: License granted

11.1 In these terms and conditions, “your content” means all works and materials (including without limitation text, graphics, photographs, audio material, video material, and files) that you submit to us or our website for storage or publication on, processing by, or transmission via, our website.

11.2 You grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

11.3 You grant to us the right to sub-license the rights licensed under Section 11.2.

11.4 You grant to us the right to bring an action for infringement of the rights licensed under Section 11.2.

11.5 You may edit your content to the extent permitted using the editing functionality made available on our website.

11.6 Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, unpublish or edit any or all of your content and is sufficient cause for such members to lose the remaining portion of their membership in HouseSitMexico without a refund.

12. Your content: Rules

12.1 You warrant and represent that your content will comply with these terms and conditions.

12.2 Your content must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

12.3 Your content, and the use of your content by us in accordance with these terms and conditions, must not: (a) be libelous or maliciously false; (b) be obscene or indecent; (c) infringe any copyright, moral right, database right, trademark right, design right, right in passing off, or other intellectual property right; (d) infringe any right of confidence, right of privacy or right under data protection legislation; (e) constitute negligent advice or contain any negligent statement; (f) constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity; (g) be in contempt of any court, or in breach of any court order; (h) be in breach of racial or religious hatred or discrimination legislation; (i) be in breach of official secrets legislation; (j) be in breach of any contractual obligation owed to any person; (k) depict violence in an explicit, graphic or gratuitous manner; (l) be pornographic, lewd, suggestive or sexually explicit; (m) be untrue, false, inaccurate or misleading; (n) consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage; 7 (o) constitute spam; (p) be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory; or (q) cause annoyance, inconvenience or needless anxiety to any person.

12.4 Your content must be appropriate, civil and tasteful, in accordance with generally accepted standards of etiquette and behavior on the Internet.

12.5 You must not use our website to link to any website or web page consisting of or containing material that would, were it posted on our website, breach the provisions of these terms and conditions.

12.6 You must not submit to our website any material that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

13.1 You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent.

14.1 Your content must not depict violence in an explicit, graphic or gratuitous manner.

14.2 Your content must not be pornographic or sexually explicit, or consist of or include explicit, graphic or gratuitous material of a sexual nature.

15.1 You must not use the website to promote or distribute any viruses, Trojans, worms, root kits, spyware, adware or other harmful software, programs, routines, applications or technologies.

15.2 You must not use the website to promote or distribute any software, programs, routines, applications or technologies that will or may negatively affect the performance of a computer or introduce significant security risks to a computer.

16.1 Your content must not be untrue, false, inaccurate or misleading.

18.2 Your content must not constitute spam.

18.3 You must not use our website to transmit or send unsolicited commercial communications.

18.4 You must not send any spam or marketing communications to any email addresses obtained from our website or through contacts made through our website.

18.5 You must not use our website to market, distribute or post chain letters, Ponzi schemes, pyramid schemes, matrix programs, “get rich quick” schemes or similar schemes, programs or materials.

19.1 You must not use our website for any purpose related to gambling, gaming, betting, lotteries, sweepstakes, prize competitions or any gambling-related activity.

23.2 Without prejudice to this general right, if you breach this Policy in any way, or if we reasonably suspect that you have breached this Policy in any way, we may: (a) delete or edit any of your Content; (b) send you one or more formal warnings; (c) temporarily suspend your access to a part or all of the website; (d) permanently prohibit you from using a part or all of the website; (e) block computers using your Internet Protocol address from accessing the Website; (f) contact your internet services provider and request that they block your access to the Website; and/or (g) bring court proceedings against you for breach of contract or otherwise.

32.2 The third party registered and unregistered trademarks or service marks on our website are the property of their respective owners and, unless stated otherwise in these terms and conditions, we do not endorse and are not affiliated with any of the holders of any such rights and as such we cannot grant any license to exercise such rights.

32. Variation

32.1 We may revise these terms and conditions from time to time.

32.2 We will give you written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of our website from the date that we give you such notice; if you do not agree to the revised terms and conditions, you must stop using our website.

37.1 These terms and conditions shall be governed by and construed in accordance with the laws of the United States of America.

37.2 Any disputes relating to these terms and conditions shall be subject to the laws of the United States of America.

38.1 We will not file a copy of these terms and conditions specifically in relation to each user or customer and, if we update these terms and conditions, the version to which you originally agreed will no longer be available on our website.
